Matters Surrounding the Arrest of the Director of Vihaan
Vihaan is a sub-franchisee in India of the Hong Kong-based direct selling company, Qnet. It so happened that on 25 January, 2019, an interim was passed by the Supreme Court of India in favor of Vihaan direct selling (India) Pvt. Ltd. The Supreme Court order stated that there was ‘no coersive action’ against Vihaan direct selling (India) Pvt. Ltd. who are the petitioners of the case. The order also stated that no coersive tips should be undertaken when it comes to the FIRs that provide against Vihaan direct selling (India) Pvt. Ltd. and this was addressed to the respondents together with the state of Telengana.
The Cyberabad police arrested on 26 January, 2019 two independent representatives of Vihaan direct selling (India) Pvt. Ltd together with the director of the company namely, Dilip Raj, Chandar Kumar Chowdary and Atur Kumar. The alleged charges for the areas for that they were involved in a Ponzi scheme through a multi-level marketing business of the sub franchise partner, Qnet.
The director of Vihaan direct selling (India) Pvt. Ltd, Dilip Raj, however body dollars to the media through a video that he didn’t have the knowledge of any financial deals of Qnet. He also added that Vihaan direct selling (India) Pvt. Ltd have no financial say when it comes to the finances of Qnet by reason of being only a sub-franchisee partner.
Qnet, in response to the rest of Vihaan direct selling (India) Pvt. Ltd’s director and the two independent representatives, stated that it was an unlawful arrest by the Cyberabad police and that the coersive action had no civil or criminal law backing or adherence because it went against the order of the Hon. Supreme Court of India. Further claims by Qnet brought to light that there was police brutality in the recording of the video by the director of Vihaan direct selling (India) Pvt. Ltd, Dilip Raj, as he was first into the recording by many threats from the police and that this was nothing short of police brutality.
Qnet put it out that transcripts of the arrest were requested from the Cyberabad police as it was against the orders of the Hon. Supreme Court of India and that they would use the transcript before the Hon. Court. Qnet said that they distributors get commissions out of product sales and that Ponzi scheme will totally be absurd in this case according to the claims by the respondent and Cyberabad police.
The public was also informed by Qnet that they should be rest assured that there is compliance with the full guidelines of the central governments ministry of consumer affairs as well as the state of Telengana in all the operations of Vihaan direct selling (India) Pvt. Ltd.
